New Issaquah Ordinance: City Can Charge More School Impact Fee Than District Requests

Under a new ordinance adopted by Issaquah City Council on Tuesday, Dec. 4, the city can now charge more—or less—than the Issaquah School District requests in school impact fees.

Although the city has authority under RCW 82.02.050 to impose school fees on individual developments to cover increased demand, the city attorney wrote in a memorandum to council, “As for the legal risks of imposing impact fees that are higher or lower than the school district requests, that is a matter that is best discussed under the attorney-client privilege because adverse consequences may result from revealing the details of my opinions to potential challengers.”
